DMX back in police custody after probation violations

DMX has been sent to prison after failing a drug test.

Prosecutors at the court in NY asked that Simmons be jailed.

DMX was supposed to be completing rehab while he was out on bail in his tax evasion case.

The rapper tested positive last week for cocaine, opiates, and Oxycodone. Early Tuesday morning (Jan. 30), the It's Dark And Hell Is Hot rapper stood before Judge Jed Rakoff, who deemed his failure to comply with the court order as a "screw you".

In fact, when the incident occurred, he was expected to continue the program.

U.S. Attorney spokesperson Nicholas Biase says prosecutors referenced the recent video and said something appeared to be off with the rapper. Heavy drinking is also a probation violation. Something definitely seemed off as he preached in a St. Louis airport bar.

"I'm saddened and disappointed", DMX's attorney, Murray Richman, tells TMZ.

"We'll have to deal with it accordingly", he told TMZ, adding that he's going to try to get the rapper into another rehab program.

He had previously agreed he would obey bail conditions, but a judge in his case has now accused of repeatedly lying about that.

DMX, real name Earl Simmons, is free on $500,000 bond pending his sentencing for evading $1.7 million in federal tax liabilities between 2010 through 2016.
